Why not? He is still liable for the support. They are trying to jerk you around. He is still in felony lack of child support, job, or no job.

I bet he would have no trouble raising the money if he were really about to go to jail. As a last resort, OW could sell the house that's in her name... or maybe not. Wouldn't it be funny if when push came to shove she left him to rot in there?

Thanks for the replies.

My lawyer has been on vacation.

He did send out a letter to ex's lawyer with a copy to the court stating that when ex's tax refund comes in we want that money.

Ex claimed in court that he will be getting between 10-11k back in his taxes and he said I could have it all.

My lawyer also stated that if we don't receive the rest of the due money by early October we will be filing for another violation petition. (Ex was claming he could get the money he invested out sometime in late september). He stated to them in the letter that he will file next time in the Supreme Court and he would get our divorce judge who may have a different perspective than the family court judge on incarceration. He is using it as a scare tactic.

Figgy, I'm sorry you have to go through this too. It sucks! Unlike your ex, my ex does own a house and a car. Support Collectios can go after either or both of those to get the money, as well as suspending his driver's license. Also, they have the right to intercept his tax refund too. My lawyer let them know that he requested such action.

My kids are grown and gone and I am thankful that is not part of the fight I'm having to deal with now, so all I can offer is my support and prayers. I've been there. Had a divorce in my twenties with 4 kids to support.

What a mess. But congratulations on standing up for yourself. If X is jailed, it is not your fault or your problem.

Your X seems to be one of the most contentious ones on the board. It is as if he is locked into battle with you to the point where he is willing to risk jail.

I bet it's fun to be OW now.
