well Bethie to answer your questions. There are a few issues as far as pension/house etc.

1. The house-the house was built on land that was quit claimed to my STBX by her mom. My name was never on the quit claim. I knew this going in. They did it to protect the land. For that reason the land equity will not be figured in "worth of the house" so that reduces equity by 17K. off the top.

2. She has no pension. She came into the M bankrupt. She has a 401K but it's worth is about 2% of the worth of mine. So she basically has nothing to trade out on.

Final mediation date is 10/8. Then the judge signs off on things.

mediator sees this stuff all of the time and most do a very fair job.

personally I think mediators suck. Ours does. Last time he wanted to know how we "felt" This time I got news for him, I could really give a rat's asss how she "feels" as a matter of fact if I have to set through a "how I feel" mediation like I did during the first one then I have decided that I'll get up walk out and let the judge decide things and let it fall where it falls.

we will see how it shakes out. My hope is she will want the house for what's owed on it. I get no equity and keep the 401K. I've managed it, I've contributed to it. She has no dog in that and has really done nothing to deserve any of it..

I'm sending you mellon sized cup holders. I know, I promised that they would work double duty as earmuffs, so I suggest that after this is over, you keep 1 as a hat and give the other one away to a friend (they don't have to know where they've been!)

House sounds Ace and I know what you mean re time. I have to much time and don't know what to do with it all. Not used to time and having no transport now and back out, it's been a long week. Thankfully I have friends to see tonight and tomorrow....oops, drinking again !!!

also..I wanted to pull this last post from my locked thread so everyone would know when I have the last mediation scheduled. SO here it is..

Update, well my L called today and left a message on my cell. The last and final mediation is set for Oct. 8th @ 9:00am. I am ready for it. I can tell my STBX is ready too. When I dropped my D2 off after visitation tonight STBX seemed happy, she was nice, she was smiling. She gave me extra clothes for D2, said I could have them for my house. Was very cordial. I know the reason for the "niceness" is because her and her L smell "blood in the water" I'm sure a big play will be made for my 401K and pension..I would make a play for hers but hers is worth about 2% of what mine is worth. So there you have it. My hope is she wants the house which she can have and allows me to keep what is rightfully mine so I'll have some sort of future later on.

My back is against the wall, Bethie has not sent my cup/earmuffs so my nuts are exposed. It sucks any way you spin it.

I find myself frustrated tonight. I have no "Mike" time. I want to go eat Mexican and drink beer, I want to go listen to a band. I want to sit in a chair and just do nothing. I can't find time to do that at the moment. I'm running my ass off trying to get time with my D and fix this house and right now all that sucks donkey peckers..Man I'm tired..

Well looks like the end is drawing near for a couple of things, mediation & the house getting done. All positives in my book.
Not too mention W being cordial, but then she is getting what she wants in the long run.. I hope that she will go along with the house for the 401k and that is it for your sake.

"Mike" time is a comin brother the finish line is near. The #1 rule about Db is to make time for yourself to make yourself better, it has been a busy last couple of months for ya but it will pay off in the end.

I know man..Started to call you last night but Indiana called

and I got distracted

and time just flew by

and the "tang" is back today

and the possibilities look endless.

and my D2 told me yesterday as I dropped her off that "she loved me and be careful" the "be careful" was a first for her. I thought that was neat.
